Section:Deceased who are to be Bathed
Topic/Issue:2001 - Case of persons who are martyred by robbers or who die in a war with people other than the polytheists. --
Agreement:The jurists agreed that the dead whose bathing is necessary are Muslims who have not been killed on the battlefield during a war with the disbelievers. With respect to the shahid, that is, one who has died in combat with the polytheists, the majority uphold the relinquishment of bathing, because of the report "that the Messenger of Allah (Gods peace and blessings be upon him) directed that the dead (of the battle) of Uhud be buried with their clothes, and he did not pray over them ".
Opinions:
Opinion FromOpinionExplanation
Imam AhmadTheir hukm is the same as that of the persons slain by the polytheistThe cause for the removal of the hukm of bathing is absolute martyrdom. They said that all those persons from among those slain about whom the Prophet (Gods peace and blessings be upon him) has explicitly said that they are martyrs are not to be bathed
Imam Malik/Imam ShafiThey are to be bathedThey maintained that the underlying cause is martyrdom at the hands of the disbelievers
