(the person is to manumit a slave first, and if he is unable to do this he is to fast, and if he is unable to do that then he is to feed the needy)The apparent meaning of the tradition about the Bedouin implies an order, as the Prophet (Gods peace and blessings be upon him) asked him about his ability to perform acts in a definite order.
Also by analogy, its similar to expiation in zihar.
Imam MalikIt is based on choice (Feeding the needy more desirable than manumission and fasting)Tradition of Abu Huraira reported by Imam Malik. The apparent meaning indicates a choice, as the word aw (or), in the usage of the Arabs implies a choice, even though this occurred in the words of the narrator, one of the Companions, who were best acquainted with the context and the implications of the words
Also by analogy, its similar to expiation in oaths
For the desirability of commencing with feeding the needy, he saw that feeding of the needy had been mentioned as a substitute for fasting on a number of occasions in the law
